Deed Restrictions in Layman’s Terms

The following is an additional explanation of the deed restrictions and architectural form. The Declaration states that all modifications to the exterior of a home, including but not limited to lawns, fences and driveways must be approved by the Board of Directors (BOD) or their appointed Committees.

In order to eliminate further confusion as to what approvals will be required, the BOD has detailed the following:

This list does not address all restrictions, but identifies the more common violations. You should refer to your legal documents for verification. In addition, this list does not approve any modification or restriction that may be omitted. This is a quick reference guide only.

   LAND/LOT

  1. Basketball goals may be anchored by a concrete and installed 6 feet from the garage. Portable goals are permitted, but must be stored upright and at least 10 feet from the back of the street curb. These goals must be in good repair and not weight down with sandbags, iron or concrete weights, bricks or any other objects.
  2. Toys may not be stored in the front yard.
  3. Lawns must be maintained and watered appropriately for the season. All dead grass must be removed and replaced.
  4. Each resident is responsible for exterior maintenance; residence, driveway, lawn, and sidewalk..
  5. Swings, sidewalks, driveways, decks, patios, courtyards, structure additions, swimming pools, greenhouses, playhouses, awnings, walls, fences and exteriors lights must be approved before installation.
  6. No trash, rubbish, garbage, grass clippings or shrubbery debris of any kind shall be kept on any lot, except the night before regularly scheduled trash pickup days.
  7. Trashcans may not be left on the curbs or sidewalk except on the night before the scheduled trash pick-up. Currently, trash pick-up is Tuesday and Friday mornings at 7:00am.
  8. No fence or wall shall be erected on any lot nearer to the street that the minimum building setback.
  9. Chain-link fences are prohibited.
  10. All fences or walls must be approved. They are not to exceed seven feet in height. Specific guidelines must be reviewed.
  11. All corner lots shall have a minimum of three live trees of at least two and one-half inches in diameter. All interior lots must have a minimum of two live trees of at least two and one-half inches in diameter in the front yard. The BOD must approve any exceptions.
  12. No fence, wall or hedge or shrub shall obstruct the view of an intersection.
  13. There will be two HOA garage sales a year. One in the spring and one in the fall. There will also be two individual garage sales a year permitted per lot.

   BUILDING

  1. The Board of Directors must approve roofing materials and paint colors.
  2. No window that is visible from any other residence or street may be covered with aluminum foil, reflective material or light colored opaque material.
  3. Any use of a residence for business must not be visible, result in noise, odor or have any impact on parking or traffic.
  4. No noxious or offensive trade or activity shall be carried on upon any lot nor shall anything be done thereon which may be or become any annoyance or nuisance to residents of the community.
  5. Construction shall be between 7:30 am and 8:30pm on Monday-Saturday and 9:00am-7:00pm or Sunday.
  6. Any exterior antennas or satellites dishes must be approved before installing.
  7. No window or wall type air conditioners are permitted.

PETS

   A.  No livestock or poultry of any kind shall be raised, bred, or kept on any
        lot.                                                                                 

  1. Household pets (domestic animals) shall be in compliance with City of Houston and Ft. Bend ordinances. When walking pets, all Fort Bend County laws must be adhered.

VEHICLES

  1. No boats, boat riggings, trailers, motor home, trailer, trucks larger than a one ton pick-up, bus, inoperable automobile, camper or other vehicle not moved for more than three consecutive days shall be parked or kept in the street.
  2. The above items may be temporarily parked in the street in front or on the side of any lot for a period not exceeding forty-eight hours in any thirty-day period. Management must be notified.
  3. Residents shall not work on their vehicles, other than a temporary basis. (No mechanic shops)
  4. Street parking must not interfere with traffic, especially emergency vehicles.

  All additional modifications must be approved as stated in the associations governing documents.
